Twenty six year old client accused of lewd molestation of 15 years old at a public establishment. The case made national and international news. Following the preliminary and waiving jury trial, the client chose to discharge her former lawyer and retain the Berlin Law Firm. The client wanted her jury trial rights back and did not want to plea blind as they were previously advised to do. Upon entering the case I filed numerous motions and conducted several hearing to obtain my client's right to a jury trial back and important evidence that had not previously been requested. The state refused every offer extended and demanded a trial by jury or my client plea blind to the judge without any benefit of a deal. My client refused. Upon completing my voir dire (jury selection) and having completely swayed the jury in my client's favor, the state proposed plea terms. The terms were rejected. However, the state readily accepted my client's very favorable counter. The lewd molestation case was dismissed, and my client pled to a new reduced charge with no prison time, nominal fine, and a short probationary period.
